Women More Likely to Initiate Divorce in Kansas and Elsewhere

Each divorce is unique and each couple has their own set of reasons why their marriage is ending. However, whatever precipitated the breakup, it is more than likely that the wife filed for divorce against her husband. Sociological studies and reviews of court filings show that approximately 70 percent of the time it is the woman who initiates the marriage dissolution proceeding. This figure is even higher among college-educated women. 

Many explanations have been provided for this phenomenon, including the following:

  • No-fault divorce — The roots of this trend can be traced back more than 50 years, when a large number of states adopted no-fault divorce laws. This allowed courts to dissolve marriages without requiring the filing party to prove some form of misconduct on the part of their spouse, such as adultery or cruel treatment. Kansas legalized no-fault divorce in 1969, so a filing party need only declare that they and their spouse are no longer compatible.
  • Shifting gender roles — Traditionally, marriages were often characterized by clear gender roles, where men were seen as the primary breadwinners and decision-makers. Today, marriage is more often treated as an equal partnership that either spouse can dissolve if they see fit. 
  • Education and financial independence — More women than men now attend college by far, and the study indicating that women with a degree are even more likely to file for divorce than the general population shows how education and financial independence can empower women to leave a failing marriage.
  • Uneven distribution of household duties — In many households, both spouses work full-time jobs, and it’s no longer noteworthy when a wife earns more than her husband. Still, when it comes to cooking, cleaning and handling parenting duties, antiquated attitudes about gender roles often prevail. Accordingly, some women feel compelled to make a change.
  • Focus on personal growth — Psychological factors also play a role. Women may be more inclined to prioritize personal growth and self-discovery, viewing divorce as a catalyst for positive change and a means to pursue their own goals and aspirations. This mindset contrasts with traditional notions of sacrificing personal happiness for the stability of marriage.
  • Abusive relationships — Women may perceive divorce as a pathway to escape from abusive or unhealthy relationships. In cases of domestic violence or emotional abuse, divorce can be a critical step towards ensuring safety and regaining autonomy.
